Welcome to SmartHousing, a multi-vendor platform connecting real estate buyers, sellers, investors and professionals. By accessing or using the SmartHousing platform, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using the services. 

1. Acceptance of Terms

By using SmartHousing, you agree to these Terms and Conditions, our Privacy Policy and any additional guidelines, terms or rules applicable to particular services. If you do not agree, you should discontinue the use of the platform. 

2. Definitions

- "Platform" refers to SmartHousing’s website and mobile applications.
- "User" refers to anyone using the platform, including buyers, sellers, vendors, investors and service providers.
- "Vendor" refers to third-party sellers, agents, landlords, developers and other real estate professionals who list their products and/or services on the platform.
- "Content" refers to all listings, descriptions, data and images uploaded by vendors or SmartHousing.

3. Platform Usage

- The platform is intended for users who are at least 18 years old. By registering, you confirm that you meet this age requirement.
- You are responsible for ensuring that the information you provide during registration or use of the platform is accurate and up-to-date.
- You may not use the platform for any unlawful purposes or in ways that violate these Terms and Conditions.

4. Vendor Obligations

- Vendors are responsible for providing accurate, truthful and complete property listings, including clear terms related to pricing, availability and property details.
- Vendors must ensure that they have legal authority to sell, rent or offer properties or services listed on the platform. 
- Vendors agree to honour any agreements made with users (e.g., buyers, renters or investors) through the platform. 

5. Buyer and Investor Obligations

- Buyers and investors must conduct their own due diligence before entering into any agreements with vendors.
- SmartHousing is not liable for any disputes, misrepresentations or issues arising between vendors and buyers/investors, as transactions are facilitated by third parties. 

6. Transactions

- SmartHousing provides a platform for connecting users but is not directly involved in any property transactions. All transactions, payments and contracts are the responsibility of the parties involved (vendors and buyers/renters/investors). 
- You acknowledge that SmartHousing is not responsible for the accuracy of listings, the condition of properties or the performance of vendors. 

7. Fees and Payments

- Vendors may be subject to listing fees, service fees or other charges, which will be clearly stated before publishing listings.
- Fees are non-refundable unless otherwise stated.

8. Refund and Cancellation Policy

- Refunds and cancellations are governed by the specific terms set by vendors for their properties or services. SmartHousing does not handle refunds for property sales, rentals or investments. 
- Any cancellation or refund disputes must be resolved between the vendor and the user directly. 

9. Intellectual Property

- All content on the platform, including text, images, logos and design elements, is the intellectual property of SmartHousing or its licensors, unless otherwise stated.
- You may not reproduce, distribute or use the content for commercial purposes without explicit permission from SmartHousing or the content’s owner.

10. User-Generated Content

- Users may post reviews, comments or feedback about their experiences on the platform. All user-generated content must be lawful, respectful and not infringe on the rights of others. 
- SmartHousing reserves the right to remove any content deemed inappropriate, offensive or in violation of these Terms and Conditions. 

11. Privacy

SmartHousing is committed to protecting your privacy. Please review our Privacy Policy for information on how we collect, use and protect your personal data.

12. Third-Party Links

The platform may contain links to third-party websites or services. SmartHousing is not responsible for the content, terms or privacy practices of third-party websites. You access such websites at your own risk. 

13. Dispute Resolution

- Any disputes arising between users and vendors must be resolved between the parties directly. SmartHousing may, at its discretion, offer mediation services but is not obligated to do so. 
- For any disputes involving SmartHousing, you agree to submit to the jurisdiction of the courts located in [Insert Location]. 

14. Limitation of Liability

- SmartHousing is not responsible for any losses, damages or issues arising from the use of the platform, including property listings, transactions or third-party services. 
- You acknowledge that SmartHousing is a platform provider and is not liable for the actions, representations or performance of vendors. 

15. Termination

- SmartHousing reserves the right to suspend or terminate your account or access to the platform if you violate these Terms and Conditions or engage in unlawful activity. 
- You may also terminate your account by contacting customer support. Upon termination, all fees owed to SmartHousing remain payable. 

16. Changes to Terms

SmartHousing reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting on the platform. Continued use of the platform after such changes constitutes acceptance of the revised Terms and Conditions. 

17. Indemnification

You agree to indemnify and hold harmless SmartHousing, its affiliates, officers, directors, employees and agents from any claims, damages, liabilities and expenses arising from your use of the platform or violation of these Terms. 

18. Governing Law

These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria.
